Getting Away With Murder.

George Zimmerman isn’t the first person that the courts have allowed to get away with murder. But he is one of the few to be acquitted after admitting to intentionally shooting an unarmed person. Zimmerman can thank Florida’s ill-conceived “Stand Your Ground” law for that, along with an inept prosecution and seemingly naive jurors.

The “Stand Your Ground” law was created as “model” legislation by the NRA (National Rifle Association) and ALEC (American Legislative Exchange Council) then introduced to state legislatures throughout the country. Designed to protect rootin’ tootin’, gun totin’, cowboy wannabes from prosecution, the law removes any obligation for gun owners to back away from a confrontation. If a pistol packin’ nitwit fears that his or her life is endangered or fears great bodily harm (an arbitrary standard as demonstrated by the Zimmerman trial) it appears that it is now legal to blast away.

Without this law, Zimmerman would have been forced to demonstrate that he tried to avoid a lethal confrontation. Without this law, the jury would have been obligated to convict Zimmerman of manslaughter. In other words, the fact that Zimmerman stalked his victim against the advice of a police dispatcher would have been reason enough to find him guilty.

The ensuing comments of juror B37 also demonstrate a lack of understanding of violent confrontations by the all female jury. The jurors apparently do not understand the difference between a fistfight and a life-endangering situation. Zimmerman’s wounds (and I use the term loosely) were consistent with the effects of a single punch. In no way do they meet the criteria of life-threatening or great bodily harm. Almost everyone who has ever been in a schoolyard fight has suffered worse.

There was no evidence that Zimmerman’s head had been repeatedly slammed onto concrete as he claimed. And that was just one of the flaws in Zimmerman’s story exposed during the trial.

The worst was Zimmerman’s claim that, when Martin was on top of him, Martin reached for Zimmerman’s gun. If the situation was as Zimmerman claimed, Martin could not have seen the gun behind Zimmerman’s right hip, let alone reached for it. Moreover, in the situation described, it would have been impossible for Zimmerman to have reached for it. Martin’s lower leg would have blocked access to it. (Having taught martial arts, including ground fighting, I have been in a similar position many times.)

The prosecution failed to clearly demonstrate this critical point. Had they done so, the jury might have reached a very different verdict.

Even more troubling than the outcome of the trial are the inconsistencies of our justice system and the perverse voyeurism of our media. As Zimmerman was getting away with murder, a Florida woman was sentenced to 20 years in prison for merely firing a warning shot to keep her estranged husband from attacking her. No one was shot. No one was hurt. The clear message is that, if you’re going to fire your gun during a confrontation, you better make sure the shot is fatal. And since the woman is black, the two incidents demonstrate the duality of our justice system.

Such inconsistency, especially the appearance of racism, deserves a serious public discussion…one free of the sensationalism demonstrated by media coverage of the “trial du jour.” Unfortunately, in search of ratings, our media would rather treat our judicial system as a series of reality shows.

Only Crimes Issa Has Exposed Are His Own.

For more than two years, Congressman Issa has been digging under rocks to find dirt on President Obama and his administration. He has claimed that his investigations would prove that the federal loan to Solyndra would expose a “sweetheart” deal for one of Obama’s political contributors. Instead, he proved that the loan process was well underway during the Bush administration.

Issa claimed that his investigation into Fast & Furious would show the president or, at least his Attorney General, ordered ATFE agents to allow gun trafficking to Mexican drug cartels. What he proved was that, out of frustration, a single unit of the ATFE allowed guns to “walk” in hopes of them leading to cartel leadership.

Most recently, Issa claimed that an investigation would show that President Obama, or his campaign, ordered extra scrutiny for Tea Party groups seeking non-profit status for their political operations. What Issa proved is that a self-professed conservative Republican agent in Cincinnati used search terms to learn more about the groups, and that those search terms included Tea Party, Patriots, and 9/12. They also included words like Democrat, Blue, Progressives, and Liberals. (I can attest to this because I’m a member of a Democratic group targeted, and I filled out the paperwork myself.)

Instead of proving that these “scandals” led to the White House, Issa proved that there were no scandals at all! Indeed, all he has accomplished is to prove otherwise. He has also caused writers like me to look into his sordid past. On doing so, I learned that Issa was twice indicted for Grand Theft Auto. I also learned that he quite likely torched his own business shortly after increasing the insurance by more than 400 percent!

It appears the only reason Issa is so determined to prove crime by others is to damage a presidency, ingratiate himself to other members of his own party and to rationalize his own past.

The War Within.

During the Cold War of the 1950’s, 60’s, 70’s and 80’s, the US and Soviet Union armed proxy nations with the world’s most sophisticated weapons. It was good business for the defense industries of both participants. And when the proxy nations went to war with one another, business got even better.

Now we’re seeing a similar phenomenon within the US.

Arms makers such as Glock, Sturm-Ruger, Smith & Wesson and Winchester continue to design and produce increasingly more lethal weapons. Thanks to the NRA, semi-automatic handguns, tactical shotguns and assault rifles are readily available to all Americans…criminals and the mentally unstable included. These weapons are aggressively marketed through dozens of magazines, TV networks and action movies.

The gun makers even promote guns that are currently banned in the US. Ads for semi-automatic weapons are placed directly across from ads offering kits to convert the semi-automatics into illegal, fully-automatic weapons. (Of course small type in the ads note that the conversion of guns is illegal.)

But that’s not the height of the cynicism of these murder-for-sale businesses.

In addition to marketing weapons to the criminal element, the weapons industry markets even more lethal weapons (including tanks) to police and security forces. That way, they profit from both sides in an ever-escalating war of lethality. The criminally insane obtain more and better weapons. Then the police increase their armaments. And so it goes.

I’m reminded of the game played by the manufacturers of radar guns for police. Once they had upgraded the majority of police departments to the latest technology, they began selling radar detectors to help motorists avoid speeding tickets. Then they introduced improved technology for the police.

The only ones to benefit from such policies are the manufacturers.

The Dismal State Of Our Union.

Upon listening to the last day of Neal Conan’s Talk of the Nation on NPR, I was surprised by Ted Koppel’s response when asked about the future. Turns out, Koppel shares many of the same concerns as I do. For what it’s worth, here is a compilation of my own views of the current state of our union and its future.

Civil Rights – How depressing that people are still struggling for civil rights nearly 150 years after the end of slavery! The Supreme Court ruling on the Voting Rights Act was a huge setback, unleashing red states to suppress minority votes.

Abortion – Although abortion was made legal in 1973, women are still fighting to wrest control of their own bodies from the old men who control our political system. Amazingly, women are now forced to fight for access to contraception!

Environment – Most Americans say they’re concerned about our environment. They just don’t act like it. Most refuse to sacrifice anything on behalf of our planet’s future.

Hunger – In the richest nation on Earth, 50 million people are unsure of where they’ll get their next meal. That includes 17 million American children!

Energy – Nearly 40 years after President Carter had solar panels installed on the White House, we’re still addicted to fossil fuels. We spill more oil than most other countries use.

Healthcare  – The dirty secret is that we have no healthcare system. We spend more than twice as much as other advanced nations, yet achieve worse outcomes. And we spend more on pharmaceuticals than the rest of the world combined.

Wall Street – Greed has turned large banks into high stakes casinos. Their gambling habit not only cost individuals and pension plans trillions…many families lost their homes. Yet any attempt to regulate these banks has been undermined by millions in lobbying efforts.

Income Disparity – The US ranks among the world’s worst nations for income inequality. 400 Americans control more wealth than half of our population, and the gap is growing. Yet Republicans believe that 47 percent are sponging off the rest!

Jobs – Simply put, we don’t have enough of them. And far too few of them pay enough to support a family. Corporate leaders and politicians, on the other hand, each make enough to support dozens of families.

Privatization – We’ve privatized prisons, prison healthcare, schools, our military, even our intelligence efforts. Although all of these efforts have proven to cost more than publicly run institutions, Republicans are pushing for even more privatization.

Pensions – We lost tens of thousands of employee pensions over the past 40 years, replaced by IRAs and 401Ks which were originally intended to supplement defined benefit pension plans. The money once used for employee benefits now lines the pockets of CEOs, executives and investors.

Politics – Our politics have continued to move to the right, even though our population hasn’t. When Republicans are in control, they unabashedly cram through partisan legislation. When Democrats are in control, they tentatively nibble around the margins instead of doing what they were elected to do. Both parties rely on large corporations to finance their political campaigns.

Tea Party – This is a relatively small group that has had a large impact. Based on lies and meanness, it seems its goal is to take us back to the 16th Century.

Surveillance – Following 9/11, we traded privacy for increased security. The NSA tracks records of our phone calls, search engine terms and emails. Banks and credit card companies track our purchases. And surveillance cameras are everywhere.

Guns – While the NRA works to increase the availability of guns, even for criminals and the mentally ill, manufacturers make guns ever more lethal.

Education – Thanks to conservatives, public education is underfunded and teachers are woefully underpaid. Enough said.

Science – Many now claim that evolution is merely a theory. But so is gravity! Of course, these people also deny man’s affect on climate change. (See education.)

Religious Intolerance – Islam is not the only religion with extremists. The intolerance of all religions seems to be growing.

Anger and Pettiness – Within 20 years of the end of the Fairness Doctrine, 91 percent of talk radio was conservative…mean, angry, venomous Rush Limbaugh-style conservative… and it’s getting worse. (See Tea Party)

War – There’s no denying it. The US absolutely LOVES war. We glorify soldiers and their war machines with military-style ceremonies and flyovers at nearly every large event. And we spend hundreds of billions on “defense” to build bigger, badder war toys.

Iraq – Iraq cost us trillions of dollars and thousands of lives. The result of our sacrifices is that we have turned Iraq into a vassal state of radical Iran.

Afghanistan – Despite setting a deadline for withdrawal, there is no clear outcome for this war. We may leave the country no better off than it was when we arrived.

Syria – Yet another opportunity to dive into a war with no real reason or plan. But it is a war and some of our politicians don’t want to be left out.

War on Drugs – This “war” may have ruined more lives than the drugs themselves. It disproportionately affects minorities, filling our prisons to overflowing. Indeed, we have a larger prison population than any other nation.

Militarization of Police – As our soldiers return from war, they’re increasingly hired by police departments. As a result, police become ever more militarized…with assault weapons and assault vehicles…and further removed from ordinary citizens.

Journalism – In the 1980’s, TV networks began measuring the success of their news organizations by ratings which instantly sensationalized the news and created the “sound bite.”  Worse, most news groups have lost their independence as they were gobbled up by conglomerates.

With all this, it’s difficult to be optimistic about the future, but the pendulum may soon swing the other way. I hope so.

It’s Difficult To Disprove A Negative.

Whenever someone accuses the government of a scandal, it’s almost impossible to disprove it. That’s because the accusation makes headlines. The truth doesn’t.

Nobody understands this principle better than Teapublicans.

When Bill Clinton was elected to the White House, he was forced to disprove a constant wave of scandals created by the GOP. Now it’s President Obama’s turn. That’s why we’ve seen a flurry of scandalous accusations about Fast & Furious, drones, Benghazi, the IRS, and NSA.

The headlines have been damning – based on outrageous claims by Rep. Darrell Issa, Sen. Lindsey Graham, Speaker John Boehner, Sen. Mitch McConnell and others. The truth has been less interesting.

For example, Issa made claims that Fast & Furious was a large scale gun-running operation overseen by Attorney General Eric Holder. The reality is that it was a small localized operation by a unit of the ATFE frustrated by Arizona’s lax gun laws and the inability to prosecute straw buyers.

Issa and others made the sensational claim that the president and former Secretary of State Hillary Clinton ignored the danger to diplomats in Libya then covered up their failures. The reality is that Ambassador Stevens twice rejected increased security and the talking points released by Susan Rice were crafted by the CIA and mid-level State Dept. officials.

Teapublicans claim that IRS scrutiny of Tea Party organizations seeking nonprofit status was orchestrated by the White House and President Obama. The truth is, the IRS director was a Bush appointee and, according to testimony by an IRS supervisor in charge (who is, incidentally, a self-described conservative Republican), the scrutiny of Tea Party groups was not ordered by the administration and was not politically motivated.

Teapublicans and many Democrats claim that NSA collection of data demonstrates that President Obama is an authoritarian fascist operating in defiance of the 4th amendment of the Constitution. The truth is, the NSA program began immediately following 9/11 and the Obama administration reigned it in, eliminating warrantless wiretaps and clearing the collection of data through the FISA court and Congress. Interestingly, the people of Europe were aware of our program long before Snowden’s revelations and the overwhelming majority approve of it.

All of this proves that, now that our press is driven by ratings and sensationalism rather than a desire to inform, unscrupulous politicians can take advantage of it. And no politicians are more unscrupulous than today’s Republican Party.

Arizona’s War On The Environment.

Arizona has a long love affair with the gun. Its legislature even named the Colt .45 as the state’s official gun. Gun shops are everywhere. And there’s at least one gun show in the state every weekend. On the other hand, there are few gun clubs or official firing wages.

So where do Arizonans go to fire all of these weapons?

They simply go into the wilderness. They shoot virtually anything in sight, whether it’s legal or not. They blast away at targets and bottles, leaving spent cartridges, broken bottles, targets and other trash in their wake. Increasingly, they leave the forest smoldering.

Over the last few years, dozens of wildfires throughout the West have been caused by hot lead. It’s difficult enough to keep Arizonans from camping when there’s fire danger; from starting campfires; from off-roading; even from flicking cigarette butts out their car windows. But no one’s going to keep Arizonans from exercising their “God-given”, Constitutional right to set the wilderness on fire.

A case in point is the Doce wildfire near Prescott. It has already been determined that the fire was human caused, but it’s not yet certain that it is the result of gunfire. What is known is that the fire has consumed thousands of acres, threatening homes. And that it began in the Doce Pit, an area popular for target shooting.

Scandalrama!

As the Teapublican House, led by witch-hunter-in-chief, Darrell Issa, looks under every rug and in every nook and cranny for dirt on Fast & Furious, Benghazi, Tea Party applications for non-profit status, the NSA, and anything else that can be used as a hammer against the Obama administration, the real work of Congress languishes.

The House still has not resolved the federal budget and the debt ceiling. It has not yet brought sanity to the nonsensical sequester cuts. It has not proposed a single bill to create jobs and lower unemployment. It has not proposed a bill to rebuild and modernize our infrastructure. It has not yet passed a bill to reduce or eliminate the waiting time for veterans’ benefits. It has not yet passed an immigration bill.

The House has not considered tax reform to eliminate loopholes that would prevent multinational corporations to stash cash in offshore tax havens. It has not passed a bill to end the senseless gun violence. It has not passed a bill to close loopholes in background checks or to control the straw buyers who provide guns to gangs and drug cartels. It hasn’t even proposed a solution for climate change caused by increasing CO2 emissions.

Teapublican congressional representatives have largely ignored all substantive issues. Instead, they have focused on trumped-up “scandals,” the repeal of “Obamacare” and a myriad of restrictive social issues all revolving around women’s vaginas. As always, they seem fascinated by the “evils” of sexual orientation and the rights of the unborn.

Meanwhile, they ignore the rights and the needs of the already living.

Marketing Guns To Kids.

For many years, I’ve used mock guns to teach disarms to martial arts students. Some time ago, government agencies banned the sale of such items if they too closely resembled a real gun. They dictated that they be colored red, orange or yellow, and that they not include any detail so that no reasonable person would mistake them for a gun.That meant that they pretty much resembled a colored block of rubber or wood with a handle. The fear was that, if they were too realistic, criminals might use one of these training aids to hold up a convenience store.

Yes, I know, it never made much sense to me, either.

Now gun manufacturers have made such restrictions pointless. It seems that bluing, silver and black are not exciting enough to attract women and kids to the shooting “sports.” So, the murder-for-sale industry is now marketing guns in a variety of colors. This trend began when they began offering pink guns to women, presumably so that attackers wouldn’t know whether to back off in fear or simply curl up in laughter.

Not satisfied to stop there, the gun industry decided to offer guns in a full range of candy-like colors, such as red, blue, green and yellow. Of course, the new colors made them much more attractive to young children. And since they look like toys, when a young child discovers a colored gun in mommy’s or daddy’s nightstand, the child is almost certain to play with it.

What did the gun industry do when it was made aware of the potential danger of these guns? Did they immediately stop marketing them? Did they recall the lethal “toys” already on the market?

Of course not.

These upstanding Second Amendment absolutists simply encouraged parents to give guns to kids so they could start shooting them at targets (and each other) at ages as young as 5! Thanks to the NRA and their Teapublican supporters, there is virtually nothing that can be done to stop them.

On the other hand, it’s still illegal to sell or own a rubber or wooden “gun” that appears too realistic.

Tea Party Conspiracy Theories: Tinfoil Hats Recommended.

Apparently, one of the criteria for becoming a Tea Party “Patriot” is to believe that our federal government is out to get you. These people actually believe that the Freemasons, beginning with our Founding Fathers, are intent on creating a New World Order in which our nation will become subservient to a New World government. Under this scenario, black-shirted thugs will arrive in black helicopters to take away our guns and our freedom.

But Tea Party paranoia doesn’t end there. These people also believe that the moon landings were staged by NASA, that the government blew up the federal building in Oklahoma City, that the government intentionally set fire to the religious compound in Waco, that 9/11 was an inside job, that Obama is a foreign-born Muslim who is the leader of al Qaeda, that the mass murders in the Aurora movie theater and the Sandy Hook Elementary School were staged by the government in order to take away our guns, and that the Boston bombings were staged by Obama in order to create more surveillance so he can take away our sovereignty and our guns.

The latest conspiracy theory being pushed by the Tea Party, Fox News Channel and right wing radio is that Homeland Security is buying up ammo to keep it out of the hands of individuals.

All of these theories have been embraced by the most paranoid Tea Party Patriots. But, seemingly, the most widely accepted conspiracy theories involve the United Nations. Paramount among them is the UN treaty on small arms sales, intended to keep weapons out of the hands of terrorists. This treaty does not regulate or interfere with gun sales within the borders of any nation, yet the wing nuts are convinced it will make the US subservient to the UN.

Perhaps, the most bat crap crazy theory of all involves Agenda 21. Evangelists for the politically insane, such as Glenn Beck, Alex Jones and Michael Levin, have worked the nitwits into a frenzy over this non-binding plan which resulted from the UN Conference on Environment and Development held in Rio de Janeiro, Brazil in 1992.

Agenda 21 sets goals for (gasp) combating poverty, promoting human health, promoting sustainable development, protecting the atmosphere, combating deforestation, managing fragile ecosystems, conserving biological diversity and much more. In other words, Agenda 21 hopes to preserve our environment so that our species, along with most others, will not become extinct.

Who wouldn’t oppose such a devious plan as that?

Aside from the Tea Party, the groups most opposed to the goals of Agenda 21 are those whose profits depend on extracting resources from the environment without regard to the long-term consequences. The major opponents are big oil, mining companies, lumber companies, corporate farming, commercial fishing, and real estate developers.

Even so, Agenda 21 includes no regulatory mechanisms. There are no punitive measures and no policing. The only consequences for nations and industries failing to follow the proposed guidelines are paid by the individuals who will suffer as the result of the water and air being polluted, forests being clear-cut, fisheries being depleted, and agricultural land being depleted or forced out of production by runaway development.

Nevertheless, the conspiracy nuts want you to be afraid…very afraid…of Agenda 21. Because, in their feeble minds, sustainability is just another word for tyranny.

Trial By Media.

For some Americans, this promises to be a big week…a very big week.  You see, this may be the week the media circus, also known as the Jodi Arias trial, reaches a climax…er, verdict.

For weeks on end, Americans have been glued to their TVs to make certain they wouldn’t miss a single salacious detail of the trial. They were riveted by testimony regarding the sexual relationship between Arias and her murder victim. They hung on every word of testimony from expert witnesses. They posted their theories on Facebook and Twitter. Many stood in line for hours in hopes they could grab a seat in the courtroom. A few even traveled to Phoenix so they could be near the event and, perhaps, catch a glimpse of some of the participants.

In short, the Arias trial was a media outlet’s dream, certain to increase ratings. The trial had it all…sex, bondage, betrayal, murder, intrigue…it was almost as if Fifty Shades of Grey had come to life.

Of course, murder trials take place daily in courts across the country. But only the most sensational garner such attention. The Arias trial is but the latest in a long line of sensational, made-for-TV trials, such as the OJ Simpson trial, Amanda Knox trial, and the Casey Anthony trial. Only the trials with the most famous celebrities, the most beautiful defendants, the cutest victims, or the most aberrant behavior draw such attention.

Whatever the verdict, such trials say far more about our society and our media than they do about the defendants.

Imagine if that kind of media attention was focused on real issues and problems. Imagine if the homeless and the hungry were covered relentlessly by news outlets. Imagine if the media spent as much time on public policy, politicians and corrupt officials. Imagine if network TV reporters covered the murders of innocent civilians caused by our lax gun laws as voraciously as they covered the murder of OJ’s wife.

Imagine if the public cared.
